S. 714 (see related story) has no effect on the current Do-Not-Call rules, which still preclude an agent from calling a current client beyond an 18-month period from the date of the original contract – while insurance carriers are permitted to contact the client for the life of the relationship.
This is unfair to, and unworkable for, agents. PIA National has filed a formal petition to the FCC, asking it to issue a declaratory ruling modifying the application of the Telephone Consumer Protection Act of 1991 (TCPA). PIA is seeking the Commission’s expedient declaration clarifying that insurance agents -- like insurance carriers -- may contact policyholders with whom they have an established business relationship (EBR) throughout the term of the insurance policy, plus 18 months.
